Accommodation Agreement and Terms of Use
The facility to which these Accommodation Agreement and Terms of Use apply (hereinafter referred to as the “Facility”) refers to the accommodation facilities managed and operated by KK NISEKO MANAGEMENT SERVICE (hereinafter referred to as the “Company”).
Scope of Application
Article 1 The Accommodation Contracts and related contracts concluded between the Company and the Guest shall be governed by the provisions of these Terms and Conditions. Any particulars not provided in these Terms and Conditions shall be governed by laws and regulations and/or generally established customs.
2. If the Company agrees to a special agreement within a range that does not violate laws and regulations or customs, that special agreement shall take precedence, notwithstanding the provision of the preceding paragraph.
Article 2 A person who intends to apply for an Accommodation Contract with the Company shall notify the Company of the following particulars:
(1) Name of the Guest(s) and the address of the representative Guest.
(2) Accommodation date and estimated time of arrival.
(3) Number of Guests.
(4) Accommodation charges (in principle, based on the Basic Accommodation Fee in Appendix 1).
(5) Other matters deemed necessary by the Company.
Formation of Accommodation Contract and Related Matters
Article 3 The Accommodation Contract shall be deemed to have been concluded when the Company accepts the application in the preceding Article. The reservation confirmation document upon the formation of the contract shall be sent by email. This shall not apply, however, when the Company proves that it did not accept the application.
Special Agreement Waiving the Requirement for Deposit Payment
Article 4 Notwithstanding the provisions of Paragraph 2 of the preceding Article, the Company may agree to a special agreement that waives the requirement for the payment of the application fee in the said paragraph after the contract is concluded.
Request for Cooperation on Infection Prevention Measures at the Facility
Article 4-2 The Company may request the person seeking to stay to cooperate in accordance with the provisions of Article 4-2, Paragraph 1 of the Hotel Business Act (Act No. 138 of 1948).
Refusal of Accommodation Contract Conclusion
Article 5 The Company may not agree to the conclusion of an Accommodation Contract in the following cases. However, this paragraph does not mean that the Company may refuse accommodation in cases other than those listed in Article 5 of the Hotel Business Act.
(1) When the application for accommodation does not comply with these Terms and Conditions.
(2) When the Facility is fully booked and there is no vacant room.
(3) When the person seeking to stay is deemed likely to engage in behavior that violates the provisions of laws and regulations, public order, or good morals concerning accommodation.
(4) When the person seeking to stay is deemed to fall under the following (a) to (c):
(a) An organized crime group (hereinafter referred to as “Antisocial Forces”) as defined in Article 2, Item 2 of the Act on Prevention of Unjust Acts by Organized Crime Group Members (Act No. 77 of 1991), a member of an organized crime group (hereinafter referred to as “Antisocial Forces Member”) as defined in Article 2, Item 6 of the same Act, an associated member of an organized crime group, a person related to an organized crime group, or other anti-social forces.
(b) A corporation or other organization whose business activities are controlled by an Antisocial Forces or Antisocial Forces Member.
(c) A corporation whose officers include a person who falls under the category of an Antisocial Forces Member.
(5) When the person seeking to stay engages in conduct that significantly disturbs other Guests.
(6) When the person seeking to stay is a patient of a specified infectious disease or a similar person (hereinafter referred to as a “Patient of Specified Infectious Disease, etc.”) as stipulated in Article 4-2, Paragraph 1, Item 2 of the Hotel Business Act.
(7) When violent demands are made regarding the accommodation, or an unreasonable burden exceeding a reasonable scope is requested (excluding cases where the person seeking to stay requests the removal of social barriers pursuant to Article 7, Paragraph 2 or Article 8, Paragraph 2 of the Act on the Elimination of Discrimination against Persons with Disabilities (Act No. 65 of 2013; hereinafter referred to as the “Disability Discrimination Elimination Act”)).
(8) When the person seeking to stay repeatedly makes requests to the Company or the Facility that are stipulated in Article 5-6 of the Ordinance for Enforcement of the Hotel Business Act as requests whose implementation is excessively burdensome and which are likely to significantly hinder the provision of accommodation services to other Guests.
(9) When the Company is unable to provide accommodation due to natural disaster, facility malfunction, or other unavoidable reasons.
(10) When the case falls under the provisions of Article 8 of the Hokkaido Hotel Business Act Enforcement Ordinance:
(1) When the person seeking to stay is heavily intoxicated or whose behavior is significantly abnormal and is deemed likely to cause disturbance to other Guests.
(2) When the clothing or belongings of the person seeking to stay are extremely unclean and are deemed to hinder the maintenance of hygiene for other Guests.
Explanation of Refusal of Accommodation Contract Conclusion
Article 5-2 The person seeking to stay may request the Company to explain the reason in cases where the Company does not agree to the conclusion of the Accommodation Contract based on the preceding Article.
Guest’s Right to Cancel the Contract
Article 6 The Guest may cancel the Accommodation Contract by notifying the Company.
Company’s Right to Cancel the Contract
Article 7 The Company may cancel the Accommodation Contract in the following cases. However, this paragraph does not mean that the Company may refuse accommodation in cases other than those listed in Article 5 of the Hotel Business Act.
(1) When the Guest is deemed likely to engage in behavior that violates the provisions of laws and regulations, public order, or good morals concerning accommodation, or when the Guest is deemed to have engaged in such behavior.
(2) When the Guest is deemed to fall under the following (a) to (c):
(a) Antisocial Forces, Antisocial Forces Member, associated member of Antisocial Forces, person related to Antisocial Forces, or other anti-social forces.
(b) A corporation or other organization whose business activities are controlled by an Antisocial Forces or Antisocial Forces Member.
(c) A corporation whose officers include a person who falls under the category of a Antisocial Forces Member.
(3) When the Guest engages in conduct that significantly annoys other Guests.
(4) When the Guest is a Patient of Specified Infectious Disease.
(5) When violent demands are made regarding the accommodation, or an unreasonable burden exceeding a reasonable scope is requested (excluding cases where the Guest requests the removal of social barriers pursuant to Article 7, Paragraph 2 or Article 8, Paragraph 2 of the Disability Discrimination Elimination Act).
(6) When the Guest repeatedly makes requests to the Company or the Facility that are stipulated in Article 5-6 of the Ordinance for Enforcement of the Hotel Business Act as requests whose implementation is excessively burdensome and which are likely to significantly hinder the provision of accommodation services to other Guests.
(7) When the Company is unable to provide accommodation due to reasons attributable to force majeure, such as a natural disaster.
(8) When the case falls under the provisions of Article 8 of the Hokkaido Hotel Business Act Enforcement Ordinance:
(1) When the person seeking to stay is heavily intoxicated or whose behavior is significantly abnormal and is deemed likely to cause annoyance to other Guests.
(2) When the clothing or belongings of the person seeking to stay are extremely unclean and are deemed to hinder the maintenance of hygiene for other Guests.
(9) When the Guest does not comply with the prohibited acts in the Terms of Use stipulated by the hotel (Facility), such as smoking in the Facility, tampering with fire-fighting equipment, etc. (limited to those necessary for fire prevention).
Explanation of Accommodation Contract Cancellation
Article 7-2 The Guest may request the Company to explain the reason in cases where the Company cancels the Accommodation Contract based on the preceding Article.
Accommodation Registration
Article 8 The Guest shall register the following particulars at the front desk designated by the Company on the day of accommodation:
(1) Name, address, and contact information of the Guest.
(2) For foreigners who do not have an address in Japan, their nationality and passport number.
(3) Date of departure and estimated time of departure.
(4) Other matters deemed necessary by the Company. 2. If the Guest intends to pay the charges in Article 12 by means other than currency, such as accommodation vouchers or credit cards, they shall present these at the time of registration in the preceding paragraph.
Hours of Use of the Guest Room
Article 9 The time during which the Guest may use the Facility’s guest room is from 3:00 PM until 10:00 AM the following morning. However, in the case of consecutive stays, the Guest may use the room all day, excluding the day of arrival and the day of departure.
(1) A prescribed additional charge will be incurred for each room. Please inquire about the amount.
(2) If the use exceeds 3:00 PM, 100% of the equivalent of the basic room charge set for each season.
Compliance with Terms of Use
Article 10 The Guest shall comply with the Terms of Use stipulated by the Company while within the Facility.
Business Hours
Article 11 The Company’s Facility mainly consists of condominiums and cottages, and the front desk shall be one location designated by the Company. Front desk service hours are primarily during check-in and check-out.
Payment of Charges
Article 12 The breakdown of the accommodation fees and other charges, that the Guest should pay shall be as listed in Appendix 1.
Company’s Liability
Article 13 The Company shall compensate the Guest for damages when the Company causes damage to the Guest in the performance of the Accommodation Contract and related contracts, or due to the non-performance thereof. However, this shall not apply when the damage is not due to reasons attributable to the Company.
Handling When Unable to Provide Contracted Guest Room
Article 14 If the Company is unable to provide the Guest with the contracted guest room, the Company shall, with the Guest’s consent, arrange for other accommodation facilities under conditions as similar as possible.
Handling of Deposited Items, etc.
Article 15 Since the Company’s Facility mainly consists of condominiums and cottages, it is not possible to store deposited items due to their nature. Guests are requested to store and manage them at their own risk.
Storage of Guest’s Baggage or Personal Effects
Article 16 If a Guest’s baggage arrives at the Facility prior to the stay, the Company shall not be liable for any damage, regardless of intent or negligence on the part of the Company, as the storage is at the Guest’s own risk.
Responsibility for Parking
Article 17 When the Guest uses the Facility’s parking lot, the Company merely rents the space, and does not assume responsibility for the management of the vehicle, regardless of whether the vehicle key is deposited. However, if damage is caused by the Company’s intent or negligence in the management of the parking lot, the Company shall be liable for compensation.
Guest’s Liability
Article 18 If the Facility suffers damage due to the intent or negligence of the Guest, the Guest shall compensate the Company for the damage. Furthermore, depending on the situation, the Guest shall pay the fee for the insurance claim procedure.
Language and Governing Law
Article 19 These Terms and Conditions are prepared in Japanese and translated into English. The Japanese version is the official text, and the English version is prepared for reference. In case of any conflict or inconsistency between the two language versions, the Japanese version shall prevail.
Changes to Accommodation Agreement and Terms of Use
Article 20 The Company may, at its discretion, change these Terms and Conditions and the Terms of Use (hereinafter referred to as “Terms”) in the following cases. The user shall accept this without objection.
(1) When the change to the Terms is in the general interest of the Guests.
(2) When the change to the Terms does not violate the purpose of the contract and is reasonable in light of the necessity of the change, the appropriateness of the content after the change, the content of the change, and other circumstances related to the change.

Cancellation and Change Policy
No refunds will be given for cancellations for any reason. We recommend purchasing travel insurance.
The percentage (%) is the ratio of the penalty fee to the basic accommodation charge.
If the number of contracted days is reduced, a 100% penalty fee will be charged for the entire reduced period.
If a change to a confirmed reservation results in a lower price (such as a change in check-in or check-out date, or a room change), the difference in the deposit or the final payment amount will be collected based on the price at the time of reservation. We cannot guarantee change requests.
For guest services not specifically mentioned (lift tickets, rentals, lessons, transfers, car rentals, food, etc.), a 100% cancellation fee will be incurred for cancellations within 30 days of the arrival date.
These terms and conditions apply only to the accommodation facilities managed by us. Facilities managed by Vacation Niseko can be found here.
If a package includes a reservation for a property not managed by us, or a guest service provided by an external company, that company’s cancellation policy will apply.
Change fee: For changes or cancellations made within 7 days, such as a reduction in the number of stay days, a reduction in the number of rooms, a change in stay dates, or a change in extra bedding or bed type, the same conditions as the cancellation policy apply.
If the number of stay days is reduced before the final payment date, a change fee of ¥5,000 per reservation will be incurred.
If the customer is unable to proceed with the package due to force majeure after paying the deposit or the remaining balance, the above cancellation policy will apply*.
Vacation Niseko reserves the right to cancel a package if it is unable to implement the arranged package due to force majeure. In the event of a cancellation due to force majeure, the customer will be refunded the package price minus any prepaid expenses.
Vacation Niseko will not compensate for external costs (such as cancellation fees for flights or other hotels) incurred due to a cancellation caused by force majeure.
*Force majeure refers to circumstances beyond control, including (but not limited to) strikes, work stoppages, accidents, pandemics, acts of terrorism, war, natural disasters, and interruptions, loss, or malfunction of utilities, communications, or computer services.
In order to ensure a safe and comfortable stay for our Guests, the Company has established the following Terms of Use based on Article 10 of the Accommodation Agreement. If the rules are not followed, the Company may reluctantly refuse accommodation in accordance with Article 7 of the Accommodation Agreement.
1, Upon arrival, please check the evacuation routes and emergency exits.
2, Accommodation by persons other than those registered for accommodation is strictly prohibited.
3, Accommodation by minors alone without the consent of a parent or legal guardian is prohibited.
4, The capacity and maximum number of guests are stipulated for each guest room. The room cannot be used by a number of people exceeding the maximum capacity, regardless of age or the need for bedding.
5, For the addition of guests within the maximum capacity during the contract period of stay, please notify the Company or the Company’s front desk each time.
6, The transfer of a part of the contract period’s rights to a third party is strictly prohibited for accommodation contracts where a consecutive night discount is applied.
7, If a Guest is determined to fall under any of the following, the Guest will be immediately refused use and asked to vacate the Facility:
・If the Guest is found to be an organized crime group, an organization or person related to an organized crime group, or other anti-social forces, etc..
・If violence, threats, extortion, unreasonable demands, or similar acts are observed.
・A person who has been previously notified of refusal of use by the Company.
・If the Guest is deemed likely to pose a danger, fear, or anxiety to other Guests, such as due to mental weakness, impairment due to drugs or alcohol consumption.
8, Selling goods, soliciting, distributing advertisements, and engaging in acts that significantly annoy other Guests, such as loud talking, singing, or creating a commotion, gambling, or other acts contrary to laws, public order, and good morals, are prohibited within the Facility.
9, Use for purposes other than accommodation, such as conducting business activities within the Facility without the Company’s permission, is strictly prohibited.
10, Unless an emergency or unavoidable circumstances arise, please do not enter areas other than those for guests, such as employee areas, outdoor emergency stairs, or machine rooms.
11, The facilities and equipment within the Facility and on the premises shall be used only for their designated purposes. Moving equipment within the guest room or significantly altering the current state of the guest room, such as by remodeling, is prohibited. Also, please do not attach anything that impairs the appearance to the windows or display items by the window.
12, The following items must not be brought into the Facility:
・Firearms.
・Items that emit foul odours.
・Extremely large quantities of baggage or items.
・Items that are easily flammable or combustible, or other dangerous items.
・Items whose possession is prohibited by law, such as drugs, guns, or swords.
・Other items that threaten the safety of other Guests or employees.
13, Bringing any pets, including dogs, cats, small birds, and small animals, into the Facility is strictly prohibited, except for objects designated by the Company (excluding assistance dogs).
14, Smoking is prohibited within the Facility. If evidence of smoking is found within the Facility, the Guest will be responsible for the cost of deodorizing and additional cleaning, up to ¥100,000. Evidence of smoking includes finding cigarette butts in the guest room or if the guest room has a strong tobacco odor. The use of incense within the guest room is also prohibited.
15, Guests are responsible for managing the keys during their stay. Please lock the door and take the key with you when going out. If the key is lost, the Guest will be responsible for the cost.
16, Lost items will be stored for 3 months from the date of discovery. Valuables will be submitted to the nearest police station within 7 days. Excluding valuables submitted to the police station, if the Guest contacts the Company, the lost item will be sent to the designated address at the Guest’s expense. If there is no inquiry for 3 months, the item will be disposed of. However, items that are difficult to store and manage, such as food, or items that are clearly waste, will be disposed of without storage.
17, The Company pays maximum attention to the protection of the Guest’s privacy, but in the following cases, staff may enter the guest room without the Guest’s permission:
・Regular cleaning during the stay.
・When an urgent need is recognized for facility or equipment inspection and repair.
・When it is evident that the Guest is engaging in acts that violate the law, violate the Terms of Use, or cause significant damage to the facility.
18, Hair dyeing is prohibited within the Facility and guest rooms. If staining occurs due to hair dye, the Guest will be responsible for the cost of additional cleaning and repair.
